Terms of Service

Read these terms before using the platform. By creating an account, you agree to them.

These Terms of Service ("Terms") govern access to and use of Alias Engine at aliasengine.comand related services (collectively, the "Platform"). By creating an account, checking an acceptance box, clicking "Sign up," or otherwise using the Platform, you enter into a binding agreement with the Platform operator on the terms below.

1. Acceptance and Contract Formation

1.1 Binding agreement.These Terms constitute a legally binding contract between you and the Platform. If you access the Platform on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to both you individually and that entity.

1.2 Clickwrap acceptance. Where the Platform presents a checkbox, acknowledgment screen, or similar control requiring affirmative consent before account creation or continued access, your act of checking that box or proceeding after reading the presented terms constitutes your electronic signature and agreement to these Terms under applicable law, including the New Zealand Contract and Commercial Law Act 2017.

1.3 Rejection. If you do not agree to every provision of these Terms, you must not access or use the Platform and must discontinue use immediately.

1.4 Supplemental policies. Our Privacy Policy and any product-specific terms referenced at checkout are incorporated by reference. In the event of conflict, these Terms control unless a checkout or feature-specific notice states otherwise.

2. Definitions

2.1"Content" means text, images, audio, video, profiles, metadata, prompts, and other materials uploaded, generated, transmitted, or stored through the Platform.

2.2"User Content" means Content you submit or generate through Studio tools, excluding Platform-owned materials and automated system outputs described in these Terms.

2.3"Studio" means the authenticated workspace where account holders create and manage AI influencers, posts, stories, and related media.

2.4"Services" means the website, Studio application, billing tools, APIs, and support channels made available through the Platform from time to time.

3. Eligibility and Platform Scope

3.1 Not an adult platform. Alias Engine is a fashion-focused AI influencer studio for creators. It is not an adult, 18+, or sexually explicit content platform. We do not offer, promote, or intend the Services for that purpose.

3.2 General eligibility. You must be old enough to enter a legally binding contract in your jurisdiction. If you are under the age of majority where you live, you may use the Platform only with permission and supervision from a parent or legal guardian who accepts these Terms on your behalf.

3.3 Parental responsibility. If you are a parent or guardian and believe a minor has accessed the Platform without appropriate permission, contact us promptly. We will take reasonable steps to disable the account and remove associated data where appropriate.

4. Account Registration and Security

4.1 Accurate information. You agree to provide accurate, current, and complete registration information and to keep it updated.

4.2 Credentials. You are responsible for safeguarding your login credentials and for all activity occurring under your account, whether authorized by you or not. Notify us immediately if you suspect unauthorized access.

4.3 One person, one account. Unless expressly permitted, you may not sell, transfer, license, or share your account. You may not create multiple accounts to evade enforcement, bans, or billing obligations.

4.4 Email verification. Certain features require a verified email address. Failure to verify may limit functionality or result in account suspension.

5. Description of Services

5.1 Studio platform. Alias Engine provides Studio, an AI character workspace where account holders design AI influencers, manage reference imagery, and generate posts and stories using prepaid credits.

5.2 Hosting role. The Platform provides infrastructure for storage, generation, and delivery of Content. Except where we expressly create original materials, we do not author, endorse, or guarantee the accuracy of your submissions or AI outputs.

5.3 AI-generated content. Images, captions, prompts, and related outputs may be generated in whole or in part by automated systems. AI outputs may be inaccurate, inconsistent, or fictional. They do not constitute professional, medical, legal, or financial advice. The Platform is designed for safe-for-work fashion and creator content only.

5.4 Service changes. We may add, modify, suspend, or discontinue any feature at any time, with or without notice, to the extent permitted by law.

5.5 Beta features.Experimental or beta features are provided "as is," may contain defects, and may be withdrawn without notice.

6. User Conduct and Acceptable Use

You agree not to:

  • Violate any applicable local, national, or international law or regulation.
  • Harass, threaten, stalk, dox, or abuse any person.
  • Upload malware, conduct denial-of-service attacks, or probe systems without authorization.
  • Scrape, crawl, or harvest data except through documented APIs we expressly permit.
  • Circumvent access controls, rate limits, paywalls, or security measures.
  • Use the Platform for spam, phishing, fraud, or deceptive schemes.
  • Impersonate another person or misrepresent your affiliation with any entity.
  • Reverse engineer, decompile, or attempt to extract source code except where legally permitted.
  • Use automated bots to interact with the Platform without prior written consent.
  • Submit prompts or instructions intended to generate offensive, disgusting, violent, hateful, sexually explicit, or otherwise prohibited content.
  • Attempt to bypass content filters, moderation, or safety controls through prompt engineering, obfuscation, or repeated retries.

We may investigate violations and cooperate with law enforcement where required or appropriate. Accounts that submit abusive or prohibited prompts may be suspended or terminated immediately and may be reported to authorities.

7. User Content

7.1 Your responsibility. You retain ownership of User Content you submit, subject to the license granted below. You are solely responsible for your Content and for ensuring it complies with these Terms and applicable law.

7.2 License to the Platform. You grant the Platform a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, publish, display, and distribute your Content solely as necessary to operate, promote, and improve the Services, enforce these Terms, and comply with law.

7.3 Review. We do not guarantee pre-publication review of all submissions.

7.4 Prohibited content and prompts. You must not upload, generate, solicit, or distribute Content — including through generation prompts — that:

  • Depicts, promotes, or implies harm to minors, or any person who appears to be a minor in a harmful or exploitative context.
  • Is sexually explicit, pornographic, obscene, or intended for adult-only audiences.
  • Is gratuitously violent, gory, disgusting, hateful, or intended to shock or harass.
  • Constitutes "objectionable material" under the New Zealand Films, Videos, and Publications Classification Act 1993 or equivalent standards elsewhere.
  • Depicts non-consensual acts, violence, or coercion.
  • Promotes terrorism, extreme violence, or instructions for serious harm.
  • Infringes copyright, trademark, privacy, or publicity rights.
  • Contains private personal data of third parties without lawful basis.
  • Is defamatory, fraudulent, or intentionally misleading in a harmful way.

7.5 Prompt abuse. You are responsible for every prompt and instruction you submit. Attempting to generate prohibited content — even if generation fails or is blocked — is a material breach. We may preserve evidence of abusive prompts and take enforcement action without refund.

7.6 Enforcement. Violations may result in content removal, account suspension or termination, preservation of evidence, and referral to regulators or law enforcement, including the New Zealand Department of Internal Affairs Digital Safety Group, without prior notice where urgency requires it.

7.7 Reporting. If you encounter Content that violates these Terms or applicable law, contact support with sufficient detail for review.

8. Intellectual Property

8.1 Platform materials. The Platform name, logos, software, design elements, and documentation are protected by intellectual property laws. Except for limited rights expressly granted, no license is conveyed to you.

8.2 Feedback. If you submit ideas, suggestions, or feedback, you grant us a perpetual, irrevocable, worldwide license to use them without compensation or attribution.

8.3 Copyright complaints. If you believe Content infringes your copyright, submit a notice containing the information required by applicable law. We may remove Content and terminate repeat infringers.

8.4 Trademarks. Third-party names and marks appearing on the Platform belong to their respective owners. Reference does not imply endorsement.

9. Studio Credits and Billing

9.1 Studio access. Studio features require a registered account and prepaid credits for certain AI generation actions.

9.2 Pricing. Fees, credit costs, and package descriptions displayed at checkout are incorporated into your order. We may change pricing prospectively; existing prepaid balances are handled according to the terms displayed at purchase.

9.3 Third-party payment processors. Card and alternative payments are processed by independent providers such as Stripe and other gateways we engage. We do not store full payment card numbers on our servers.

9.4 Statement descriptor. Authorized charges initiated through the Platform typically appear on your financial statement under the descriptor ALIAS ENGINE. You agree to recognize this descriptor as valid for Platform transactions.

9.5 Chargebacks. Filing a chargeback without a good-faith billing dispute, including claims that you do not recognize ALIAS ENGINEafter using the Services, may constitute fraud and breach of these Terms.

9.6 Taxes. You are responsible for applicable taxes unless we are legally required to collect and remit them.

9.7 No refunds except where required. Except as mandated by consumer protection law or expressly stated at checkout, purchases are final once credits are delivered or digital services are rendered.

10. Platform Operator

The Alias Engine brand and aliasengine.com website are operated by Ghost Coin Limited, which handles platform operations, contractual performance, and payment infrastructure for the Services described in these Terms. Throughout this document, references to "Platform," "we," or "us" refer to the operator of Alias Engine and its Services.

11. Third-Party Services and Links

11.1 Integrations. The Platform may integrate third-party services for authentication, hosting, analytics, payment processing, or AI inference. Your use of those services may be subject to separate terms.

11.2 External links. Links to third-party websites are provided for convenience. We do not control and are not responsible for external content, policies, or practices.

11.3 No partnership. Mention of a third-party product does not create a partnership, joint venture, or agency relationship.

12. Privacy and Data Protection

Our collection and use of personal information is described in the Privacy Policy available at /privacy. By using the Platform, you acknowledge that you have read that policy. Where processing is necessary to perform our contract with you, provide security, or comply with law, you consent to such processing as described therein.

13. Suspension and Termination

13.1 By you. You may stop using the Platform at any time and may request account deletion through available account settings or support channels.

13.2 By us. We may suspend or terminate your access immediately, with or without notice, for any violation of these Terms, suspected fraud, legal requirement, extended inactivity, or risk to users or the Platform.

13.3 Effect. Upon termination, licenses you granted survive only as needed for archival, legal compliance, and dispute resolution. Sections that by nature should survive will remain in effect.

13.4 No liability for termination. We are not liable to you or third parties for termination or suspension conducted in accordance with these Terms.

14. Disclaimers

14.1 As-is.THE PLATFORM AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

14.2 No guarantee of availability. We do not warrant that the Platform will be uninterrupted, secure, or error-free, that defects will be corrected, or that Content will be preserved indefinitely.

14.3 User conduct. We are not responsible for conduct of users or third parties, whether online or offline.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE PLATFORM, ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED NEW ZEALAND DOLLARS (NZD $100).

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

16. Indemnification

You agree to defend, indemnify, and hold harmless the Platform and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your Content; (b) your use of the Services; (c) your violation of these Terms; or (d) your violation of any third-party right or applicable law.

17. Dispute Resolution and Governing Law

17.1 Governing law. These Terms are governed by the laws of New Zealand, without regard to conflict-of-law principles.

17.2 Jurisdiction. You agree that courts located in New Zealand shall have exclusive jurisdiction over disputes arising from these Terms or the Platform, and you consent to personal jurisdiction in those courts.

17.3 Informal resolution. Before filing a claim, you agree to contact us and attempt in good faith to resolve the dispute informally for at least thirty (30) days.

17.4 Time limit. Any claim must be brought within one (1) year after the cause of action accrues, to the extent permitted by law.

18. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will post the revised Terms on aliasengine.comand update the "Last Updated" date (June 2026 or later). Continued use after changes become effective constitutes acceptance. If you disagree with revised Terms, you must stop using the Platform.

19. General Provisions

19.1 Entire agreement. These Terms, together with incorporated policies, constitute the entire agreement between you and the Platform regarding the Services.

19.2 Severability. If any provision is held invalid, the remaining provisions remain in full force.

19.3 No waiver. Failure to enforce a provision is not a waiver of future enforcement.

19.4 Assignment. You may not assign these Terms without our consent. We may assign our rights and obligations in connection with a merger, acquisition, or sale of assets.

19.5 Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including outages, acts of God, war, labor disputes, or third-party service failures.

19.6 Language. These Terms are drafted in English. Translations are provided for convenience only; the English version controls in case of conflict.
